Won't work. I mean, they might give her the title, but given that there is a court order appointing someone else, her appointment would be invalid and defendants will challenge her authority to prosecute.

Also, as [checks notes] Andrew McCarthy of National Review points out, the statute does not permit someone to serve twice as an interim. I don't know if that's true because I haven't checked it, but Andrew McCarthy is not exactly the type of person who would trying to thwart Trump.
 
Funny how the GOP cared so much about the validity of appointments to Fani Willlis' RICO team and so little about the validity of other prosecutors.

If I was a district court judge in that circuit, I would dismiss a case against a defendant because the prosecutor was acting ultra vires. That would replace Alina Habba with a quickness

I guess there will be no convictions in NV now.

The district court judges have the power to force the administration's hand. They don't need injunctions. They can just dismiss cases, exactly as Trump begged the GA judges to do.

And I fucking hope they do, because someone needs to stand up for the rule of law. I'm hopeful that Judge Boulware will do it, if he's still on the bench in LV. I know him a little bit and I think he has a lot of integrity and he's smart.
