From a former Principal Deputy Assistant Attorney General for DOJ's Office of Legal Counsel:
Reliance on OLC advice will immunize unlawful conduct from prosecution. But there are two big reasons to doubt that OLC protection will be available here: (1) OLC evidently issued its opinion on boat strikes 3 days after this incident. (2) That opinion reportedly says that laws of war apply to boat strikes. But this alleged conduct would violate the laws of war.

Whomever ordered the 2nd strike should be charged and tried as soon as the current cabal is out of office. They knew damned well that 2nd hit was illegal.

I would be interested to know how precisely Americans in the armed forces are putting their lives on the line against the "narco-terrorists". I'm honestly asking...what risk the folks in boats in the Caribbean pose to those in the US military.
