A MAGA acquaintance this week was going on about how Trump was exonerated for the documents theft case. I told hi. That wasn’t at all what the situation was. Isn’t the appeal of that case coming up shortly? What’s the status there? It isn’t dead yet, right?

IIRC, the appeal won’t be heard until October, but yes it is being appealed.

Trump seeks to delay his hush money sentencing until after the election

His lawyers are seeking to have the conviction overturned on immunity grounds.

"...
And they argued that the sentencing should be delayed in order to allow Trump to weigh appellate options in response to Justice Juan Merchan’s upcoming ruling on whether Trump’s conviction should be tossed out in light of the Supreme Court’s July 1 decision on presidential immunity.

Merchan is set to rule on Sept. 16, two days before the scheduled sentencing, on whether the presidential immunity decision should have an impact on Trump’s conviction. If Merchan — as many legal observers expect — rejects Trump’s bid to overturn the conviction on immunity grounds, the judge should not proceed to sentencing until higher courts can review that ruling, Trump lawyers Todd Blanche and Emil Bove wrote.

etting aside naked election-interference objectives,” they wrote, “there is no valid countervailing reason for the Court to keep the current sentencing date on the calendar.”

Trump’s lawyers bid is likely a long shot. Merchan already pushed the sentencing from July to September in order to weigh the immunity ruling, and noted in a recent filing that the Sept. 18 sentencing date “remains unchanged.”

But Trump has succeeded in some of his numerous attempts to delay aspects of the proceedings in the Manhattan case, including pushing back the start of the trial in the spring by three weeks due to a document dispute. ..."

He did make many of the monthly payments while sitting Prez. However, the plan had been hatched and agreed to prior to taking office. They just spread they payments out monthly to make it appear as legal services.

Also, there is no way that a claim can be made that paying off a personal attorney, per an agreement made prior to taking office, to repay for keeping a porn star quiet. Also, illegally accounting for it on the books of your private company.

No way those are official acts of a sitting Prez, though who knows exactly how corrupt and political Thomas and Alito are willing to be.

No, but using the statements and conduct of Trump during the presidency as evidence of his state of mind is barred by the immunity decision. And the prosecution did that.

Trump has waiver and harmless error problems, but his argument isn’t frivolous.

What specific official Presidential acts were referenced?

I'm not sure what you are alluding to here. So another way of asking would be, if any of his crazed loony whine fests on Twitter were ever brought up in a court of law, is that deemed an official act just because he is president?

Like calling people names, accusing people of being biased against him, calling judges and witnesses biased and the process just another witch hunt. How is any of that crap any part of the job or an official duty?

As corrupt as Thomas and Alito are (as well as other judges and justices), they’ll all do what Leonard Leo, Harlan Crow, and their allies tell them to do.
