after watching a clip of Comey's response last night, he seemed to be welcoming a trial so I wonder if his lawyers are going to try to get the case dismissed or let it go to trial.

I'm guessing going to trial would mean getting a lot of discovery info ? and that discovery info could be used for Comey to build a case against Trump and the DOJ for instigating and pursuing an unlawful criminal investigation ?

I'm not a lawyer so I welcome our board legal beagles to weigh in.

Correct me if I'm mistaken, but I'm curious why we haven't (yet) heard from our resident unabashed Trump-supporting attorney expressing concerns about "lawfare." Guessing because in this case, it's accountability. Right?
Our board MAGAs have gone silent on this one which is pretty much par for the course when Trump takes another step forward to autocracy.

I believe the party line is "You guys started it" (implicitly admitting that it's wrong) while ignoring that Trump's current targets (Comey, Bolton) are not even Democrats.
 
If this does ever get to trial, Trump's posturing will provide a script for the defense to show that this is all about political persecution. Since the allegations are about lying to Congress, all of the underlying facts from the Russian interference investigation come into play. While a clear motive to interfere on behalf of Trump was not found, interference was. Even if the motive was only to undermine the election process and the integrity of elections, the Trump family's business (financing failing businesses with Russian money) and political maneuvers (Don Jr.'s efforts at seeking to throw dirt at Biden) become relevant to the defense's theory of the case.

The poster you reference is perfectly happy for Trump to do this sort of retribution "lawfare" and will be cheering him on every step of the way

The motive wasn't what was missing - what was missing, in the mind of Mueller, was clear evidence that the Trump campaign was intentionally cooperating with the Russian election-influencing efforts 9as opposed to simply being unwitting dupes in the efforts of the Russians). Basically it was clear they were either traitors or idiots, but it wasn't clear which one.

And of course recoils at the idea that there should be consequences for him or his people.

Which is why there needs to be consequences. Severe ones. Even if Trump does recede from the scene, MAGA isn't going anywhere. Ram isn't ever going to be more informed, less racist, or less bigoted. The only way to get the Ramrousers of the world to favor the rule of law is to show them what happens when they don't respect it.

The problem is that conservatives know they can get away with it. Part of that is the Supreme Court, but part of it is liberals who don't punish the aberrant behavior in the name of "unity." It was a huge mistake in hindsight for Obama not to prosecute Bush torturers. I understand his reasoning, and it was persuasive at the time (there was a financial crisis, after all), and we couldn't foresee the future. But we shouldn't make the mistake again.

It was a mistake for Garland not to go after Trump harder and sooner. I don't think that mistake was consequential in the sense of locking Trump up. The Supreme Court was never going to let Trump be convicted of anything. And again, I understand the reasoning. Liberals generally want government to be successful, and that's not what prosecutions do in the short term. But we should understand that our freedoms require that MAGA, like smallpox, must be eradicated.

And we need a new constitution.
