I am now worried about the birthright citizenship case. I had thought, based on oral argument, that none of the Justices were even interested in taking the argument seriously -- but now I don't know if that means anything. They are just accepting the worst arguments imaginable on a regular basis, so why not that one.
 
I totally get it. These SCOTUS decisions (or wimpy “stays”) which further emboldens the regime (it’s not an administration anymore, but a regime) is the reason I started the tin foil hat thread. “Turn out the lights… the party’s over.” (He sang in his best Don Meredith impersonation).

Boston Tea Party would be better. The motives still aren't pure but the real interests of America are at stake. I agree people are being hasty but be careful how you identify what's going on.

The state of nature is war. We avoid war with the rule of law. If the rule of law disappears then might makes right and war is the natural outcome.

The Supreme Court shredded the rule of law yesterday. They have been chipping away at it for years, but staying an order that the government defied is way too much. It's Enabling Act type of stuff.

Trump's interpretation of the last two months will certainly be -- and he will be right about it -- is that the Supreme Court is going to sweep aside any resistance to his lawlessness by staying all orders that go against it. That isn't rule of law. That is dictatorship.

Did you know that the Soviet Union had a constitution? It was magnificent. It guaranteed rights of free speech, free assembly, voting in elections, etc. Yet the gulag existed. How? Because constitutions are useless if there is nobody to enforce them against the executive.

The Supreme Court has turned the US constitution into the Soviet constitution -- a useless document that is little more than a fig leaf for pure authoritarianism.

You know how people like you love to say stuff like, "we don't want the smoking gun to be a mushroom cloud"? Well, I don't want the smoking gun to be a death camp, get my drift?
 
I don't understand the last sentence. Your analysis above it is correct. The qualifier is fine; it's just that the probability of misuse is extremely high, which doesn't contradict anything you said.
I was referring specifically to the misuse of this ruling to deport/disappear citizens but also acknowledging that the intended use of this ruling is itself of misuse of the rule of law. Something like that.

Agree fully except for that one sentence. When you moderate your comments about fascism is when you lose credibility. If some are offended, too bad. We are losing our Constitution, our democracy and, eventually, our freedom; and, I'm suppose to worry about being offensive.

The Supreme Court has given Trump absolute power. He is now in fact ruling America with an iron fist. We have the military and ICE roaming freely in the streets. There's no such thing as due process, because the Supreme Court has stayed every district court order trying to enforce due process. Anyone can now be picked up and whisked away to South Sudan or El Salvador or anywhere and there is nothing you can do about it because they are only giving an hour's notice, or two hours notice, or 15 minutes notice. Not enough notice even to contact an attorney, let alone file anything. Oh, and by the way, they don't have to tell anyone where they took you.

At this point, we need to be gearing up for Civil War. You think this is an exaggeration? Trump now has more power than King George III ever had. King George was limited by the Magna Carta. The US does not even have a Magna Carta any more. We have nothing except selective reading of the bible.

And y'all are worried about manners. Oh no, we wouldn't want to offend anyone by saying that if we are to get our country back, certain people need to be removed from office AND made examples of. Any judge who denies due process to others should not be afforded due process themselves. Saving the country means cleansing the judiciary of the "judges" who hate the constitution, hate America and never had any intention whatsoever of applying the law. It is a coup.

So if you're complaining about my rhetoric, then get a fucking clue and GFY. I'm not the enemy. Nothing I write is the problem. The problem is the fascists who control all branches of government.
