Idiot question but what was Jason doing? He grabbed the guy's phone, trashed it, picked it up and walked away. There are several criminal offenses there, including theft. At a minimum he's going to get sued. Maybe he gives the guy a grand to go away and he doesn't care about that, but I hope the DA does not look the other way on the assault/theft. There needs to be mandatory community service at the least.
