The analysis is solid, in the same way that contending 1+1=2 is solid. DOJ never presented a serious argument, nor could they do so because the retaliation was obvious. I mean, they announced that it was retaliation. Even a currently serving service member would probably not be permissibly disciplined for it, but definitely not a retired service member.

There is not a lot of precedent for this kind of case (for good reasons) so that makes it like 1 + 1 = 2 only if no one had ever thought to ask what 1 + 1 equals. There were certainly enough legal uncertainty and discretionary legal theories that a judge, if he or she were so inclined, could have denied a PI. Fortunately, this case was not before Judge Cannon, Kaczmarek, Alito or Thomas.
