The older man has now filed a suit again Fox:

"The lawsuit accuses Fox Corporation of not supervising Sanchez’s behavior and that it should have known about his “propensity for drinking and/or harmful conduct.”
Sanchez is not Captain Hazelwood on the Exxon Valdeez. Fox has no duty of care to members of the general public to supervise its alcoholic independent contractors.

But Sanchez doesn’t have the kind of money the victim’s lawyer is looking for. If Fox is paying his airfare, hotel, meals and all the other things associated with a business trip, they will try to claim Sanchez was on the clock.

Feels like a fishing expedition by the victim's lawyers. Others with legal expertise can correct me, but if Fox knew he had a history of violence or substance abuse maybe they could be held liable for not supervising him properly?

This isn't vicarious liability like when a Walmart truck driver rear-ends Tracy Morgan (1. outside course/scope employment, 2. Sanchez isn't an employee in all likelihood).

This is a negligent supervision claim. Basically the plaintiff lawyer is arguing that Fox had some special duty because they knew Sanchez was a loaded weapon and they couldn't just leave that weapon lying around where it would hurt somebody. That is a crazy claim. If I hire a shitty plumber to fix my toilet, I am not responsible when he gets in a fight with my neighbor -- even if I know the plumber is an alcoholic. I have no duty to my neighbor to hire sober plumbers.

Also, I would bet Sanchez's net worth has to be pretty damn high. Maybe not 9 figures, but at least getting up there.

He wouldn’t be the first professional athlete to squander a fortune but he should have plenty of money.

Yeah, the CNN story mentions that the old man is suing Sanchez, which I expected. The Fox angle seemed like a different twist. But it also does seem like a fishing expedition, as someone mentioned.

Take a third off the top for taxes and another third for spending.

Based on my experiences of insuring F500 companies, I wouldn't be surprised if Fox paid a good sum just to move the plaintiff past the headlines.
That made sense when United dragged a doctor off the plane and broke his teeth. I'm not sure this is a case that even moves the needle for Fox from a PR perspective. No one thinks Fox did anything wrong.

I can only tell you my current experience negotiating for F500 companies on very questionable cases. It certainly does not seem like they feel that all publicity is good publicity as the saying goes.

I have been negotiating catastrophic injury claims for 30 years and I've never seen such a willingness to write checks. For clarity, this is not a situation where these companies are just pressuring the insurance carriers to pay, but these are companies with $50-100m self-insured retentions paying out their own money.

I definitely did some drunken wind sprints up and down the hallways of Ehringhaus when I was a freshman. Fun times, but glad I grew out of that.

Also amazed that he’s only 38. Been around so long I would’ve said mid-40s.

Meh, given that Sanchez was on a work trip, Plaintiff's attorney wouldn't be doing his job if he didn't at least try to rope Fox in. Another pocket (with plenty of insurance) is another pocket.
