This is the corrosive effect of the Supreme Court's stay-binge this summer. It's exactly what I was talking about.
It wasn't that long ago that the Times would already be in court seeking to enjoin that type of restriction. Now nobody is even suing because they don't see how they can win because the Supreme Court will just stay any ruling they obtain. Probably without explanation.
