Trump having judges he appointed in his first term in his pocket this term is going to expand his power considerably (Trump appointed Tipton in 2020).
not that much. plaintiffs get to choose venue. when trump becomes president, he and his adminstration will become defendants. the federal courts in texas will become considerably less busy, and federal courts in other jurisdictions will be busier.

i suspect this is why the dems have prioritized a greater number of district judges over a smaller number of appellate judges, which would have been unthinkable a decade ago.
 
Most of them have enough money to be concerned about the power that this would give Musk. That's a lot bigger concern than their next yacht.
You could be correct but I see their interests aligning with Musk's a lot more than with Trump’s. The ultra wealthy have that common bond.

lol. you really have no clue. i'll give you a hint, and you can try again if you would like: jurisdiction is a binary. you have offered criteria (necessary or not, depending on the context) for establishing jurisdiction. if you'd prefer a different formulation, you can call them different types of potential jurisdictional defects. or different bases for jurisdiction. but they are not different forms of jurisdiction. this is fundamental.

maybe it will take less time to establish the legal concepts that you do understand. lol.
 
The Tech Broligarchy is going to push Trump out with the 25th Amendment the second they have the chance. Vance is already 100% in their pocket.
the 25th has to be one of the most misunderstood amendments. a friend of mine wrote a paper on it. i was like, who is this paper for? who doesn't understand the 25th? and he said, you'd be surprised. he was right. so, before i criticize here, i will say that i have it on good authority that law professors sometimes make this very same mistake.

but anyway, the broligarchy cannot push trump out with the 25th, because of the last paragraph of the amendment. all that would happen is that they could push trump aside for a few days. then trump would tell congress, 'i am fine,' and he would be restored unless 2/3 of both houses votes to remove him. are there R 20 votes in the senate and 80+ in the house to get rid of trump? i have my doubts. and i suspect that the plotters would have the same doubts, and avoid plotting.

as this issue has never come up before, i do not know what criminal penalties could await someone who launches a bad faith 25th amendment attack on a president. but i suspect there would be some statutes that apply (including, perhaps, the catch all conspiracy against the united states). but i doubt the majority of the cabinet will just do it without asking some lawyers some questions.

pretty sure he is going to get sued again. and he will lose again. and the punitives will be massive.

a lot of southern states still have criminal defamation statutes on the books. they were mostly defanged by nyt v sullivan, but certainly trump is creating a new category of cases in which criminal defamation should apply. i don't know if ny has a criminal defamation statute (i think most states did at one point) but if there is one, now would be the time to roll it out.

This is true. American swing voters basically vote on the price of gas and generalized economic sentiment and virtually nothing else matters. The same voters will vote for everything ranging from a fascist to a communist depending on how much gas is and how they feel at the grocery store checkout.

just not true and way oversimplifying and missing the message that was sent and corroborated by the left's media numerous times. You guys have grossly underestimated how out of touch you are.

Bologna. 80% or more of the votes cast for either candidate came from people who couldn't explain one single actual policy proposal of the candidate they chose.

Out of touch from an economic perspective, sure. By most objective measures the economy has been quite good under Biden. Record stock market gains, low unemployment, etc. But people are struggling due to the rampant global inflation that happened from 2020-2022. Incumbents throughout the western world got crushed in the last few years because of it.

But seriously, were Republicans “out of touch” in 2008, 2012, and 2020, but magically in-touch in 2016 and 2024? No. American swing voters only give a shit about their pocketbooks. Economy went to shit in ‘08 on W’s watch so Republicans lost. By ‘16 people felt like the economy could be better so Republicans won. In ‘20 the economy went to shit because Trump shit the bed on COVID response so Republicans lost. In ‘24 people still haven’t recovered from COVID inflation so Republicans won. It really is that simple, and as Trump fucks up the economy with his tariffs and general pissing off of our allies and trade partners, Republicans will get hammered in’26 and ‘28 assuming we continue to have free and fair elections, which is far from a guarantee with the clown show coming to town.

Id say most don't even monitor their pocketbook all that closely. It's about how they FEEL about their finances. Many could be well ahead of the curve financially but have one sticking point of pain (like eggs or gas) and hyper-focus on that enough to change their vote.

I see this ALL the time in negotiations in real estate transactions. Sellers often refuse to offer to compensate a buyer's agent when they place a home on the market but then agree to pay buyer closing costs which are directly used to compensate the buyer's agent. The seller FEELS empowered and that they "won" when the reality is that their net is the same or worse than it might have been otherwise. I personally dont care what they do, but I'm amused at how much of a hill to die on it becomes for some in spite of the negligible impact on their bottom line.

You guys were repeatedly warned about being too woke, biden's mental collapse, the out of control border, inflation (excluding gas prices), gas prices, the over zealous attacks on trump (you actually made him a martyr) etc. What did you do? It was a "we know better than you mentality". You actually shunned the democratic process and handpicked the worst possible, least likable, and one of the most woke people in your party. And you think it was just ignorance by centrist voters who were to dumb to see beyond egg and gas prices? That is the height of lacking awareness. As for caring about their pocketbooks, that isn't a shocker or anything new. Was your side to brain dead to understand that?

i hope trump takes your medicare, medicaid, social security or whatever other safety net measures you rely on. i hope that you are unable to find enough labor for your demand because trump deported it. you were repeatedly warned about it. when it happens, i can tell you in advance to gfy. you will find sympathy nowhere.
