I don't know about the IQ thing. He was G'Town Law, clerked on Second Circuit. While I agree he's far from the brightest light in the judicial sky, there are some true idiots on the bench. Half the Fifth, for instance. That woman on the 9th who wrote the opinion striking down CA's ammunition ban -- note the dissent there was from BYBEE, as somehow the case drew a panel of entirely right wingers.I want to be sure everyone understands what's happening here. Emil Bove is an ignoramus. I would be shocked if he has an IQ above 85. But to his credit (I guess), he's been willing to represent Donald Trump in any legal action brought against him, no matter the merits, and no matter how much he would have to compromise his integrity and his ethical obligations to represent his client.
Because of his loyalty to Trump and his willingness to compromise any semblance of legal ethics, Bove was elevated to an absurdly high position in the DOJ when Trump was re-elected to the presidency. In that role, Bove instructed (and there's really no question about this at this point) the DOJ attorneys who reported to him to lie before federal judges in order to advance Trump's preferred talking points on various matters, especially those concerning immigration.
Now, as a further reward for his loyalty, Bove has been nominated by Trump for a lifetime appointment as a circuit judge on the Third Circuit Court of Appeals. If Bove were to submit to an IQ test, there's no question whatsoever he would fall in the bottom 1% of federal circuit judges.
To make matters even worse, if Bove is confirmed, he will automatically be one of the top two or three candidates for the Supreme Court if a spot opens over the next 3.5 years. Bove would be, BY FAR, the dumbest Supreme Court justice in the history of the republic if he were to assume such a position.
Much has been made of the movie Idiocracy. But the fact that Emil Bove is being seriously considered for an appellate judgeship, and is a viable candidate for a Supreme Court judgeship, is one of the most embarrassing things that has happened in the 250 year history of this country. If this happens, we will truly be living in an idiocracy. A kleptocratic idiocracy headed by a meglomaniac.
I'm trying to envision standing before Judge Bove at a Third Circuit argument and avoiding the temptation to laugh in his face. Sorry. I can't do it. It's like if Peewee Herman was nominated to a federal appellate judgeship. Or, to be more visually accurate, Herman Munster.
Fair enough. I certainly haven't been in front of all appellate judges. Oh, and the Eighth Circuit ain't exactly Einsteins either.
But Bove shouldn't be a judge. Full stop. At the same time, it's no more embarrassing than Clarence Thomas being appointed to the Supreme Court as a supremely unqualified token.
