He wasn't "attacking" law enforcement, and he had been disarmed. Patel is basically saying "if you cross us in any way, you die, even if you're unarmed (as this guy had been unarmed by ICE) and we've already got you on the ground." It's just thug behavior with the official sanction of the government.
