Hey @Ramrouser did you know that "the First Amendment prohibits government officials from relying on the threat of invoking legal sanctions and other means of coercion to achieve the suppression of disfavored speech"? Did you know that "Government officials cannot attempt to coerce private parties in order to punish or suppress views that the government disfavors"? How about this: "A government official can share her views freely and criticize particular beliefs, and she can do so forcefully in the hopes of persuading others to follow her lead. In doing so, she can rely on the merits and force of her ideas, the strength of her convictions, and her ability to inspire others. What she cannot do, however, is use the power of the State to punish or suppress disfavored expression."

Any idea what case that's from, ram? Or do you need to get one of the younger folks in the office to help you use Westlaw?

Greg Gutfeld literally mocked Melissa Hortman's death just this week. When another commentator compared Melissa Hortman's death to Charlie Kirk, Gutfeld mocked the comparison and basically said that nobody had ever heard of Hortman (including him) so it wasn't the same as Kirk's. There is no doubt - none - that if a liberal talking head had done that then there would have been major pressure for them to be fired (and in the current climate they likely would have), but for Gutfeld there was just crickets and not even a reprimand, much less a firing. There is a clear and growing double standard for liberal commentators and entertainers and journalists versus conservative ones - they can say anything and people shrug, including their employers, but let a liberal behave the same and it's an outrage and the knives come out for them.
The employers don’t just shrug. They applaud.

Nexstar made a business decision. Kimmel was spewing fake news and the company decided the show wasn’t a right fit for its stations. Plus, Kimmel was only drawing 1.7 M viewers (same as Colbert) so it’s not like the show was making the stations tons of money.

Gutfeld’s going to get some new viewers.
Why wouldn’t Gutfeld already have those Kimmel viewers? The shows dont air at the same time, so the viewer could watch both live.
 
It was the government threatening to take action against a private company because it didn’t like what a private citizen said. Textbook first amendment violation. Jimmy is going to be even richer soon.
Jimmy only has standing to sue ABC, and that would be for breach of contract
 
Just keep a long memory, liberals. As I've been saying, they won't stop if they don't get hit. When we get the chance, we need to hit them 10x harder back. Preferably that would mean selling a few states to Canada, but in any event, no more going high or appealing to our better natures.

Fascists think of nothing but concentrating power and we would be hard pressed to compete with that. Fascists are like Tyler Hansbrough when it comes to controlling people. Relentless and not distracted. So we definitely cannot tie our hands behind our backs by preaching virtue.

It's the same logic as punitive damages. Compensatory damages are often thought to provide insufficient deterrence, so to prevent companies from selling exploding cars because it's cheaper to settle than to recall, punitive damages are needed. Same thing here.

Yes. And Trump has always shown a willingness to politicize the antitrust decision making. Even back in his first term, right at the beginning, he tried to block the AT&T/Time Warner merger because he didn't like CNN. They actually went to court and basically got laughed at by everyone.

If Nexstar is really trying to buy its closest rival (I don't know what their market is, or how the market is defined), that would be a flagged transaction that any DOJ/FTC would review closely. It could go either way. Pretty sure Nexstar was buying something by cancelling Jimmy. Trump has been railing against Jimmy for years now.
