Republican concedes long-unsettled North Carolina court election to Democratic incumbent

'Bout damn time. I was talking with a retired judge friend of mine yesterday about this.... he said the next election is not that far away. Go ahead and concede now and use the entire episode as campaign fodder starting... now.
 
Glad he got his day in court and glad the judiciary got it right. Now that we are through it, the GA and/or election commission should clean this up so we don't have this issue in the future.

His day? He got seven months and about 10 different tribunals. He dragged this out about six months too long - enabled by a politically motivated NC court system.

The Pubs in the GA are what caused the issue. They are trying to do everything they can to change the rules after the fact to keep power, even if they lose. Just look at what they are doing with the governor's authority and taking away power from the election board.
 
Now hopefully all this crap the Pubs are doing in the legislature will be reversed by the court.
Nope. The Republicans still hold a solid majority on the NCSC. The NC Supreme Court isn't even a road bump to Republican aspirations to reverse the timeline of history. The only hope North Carolina has of returning to a functioning majority rule democracy is if the under 30 crowd starts voting with the same frequency as the over 65 crowd. We both know that's never going to happen.

10 tribunals? Let's see -- BOE, NC appeals, NC Supreme, NC trial (?), federal district court, federal appeals court, possibly a second appeals court (I just skipped over the procedural history in Myers' opinion but there was apparently a Griffin I and Griffin II). Yep, lot of tribunals. I'm probably missing one or two. Damn.
 
I thought there was a decent chance this ended here rather than Griffin appealing to the Fourth Circuit. I think he and his lawyers knew the Fourth Circuit would uphold Myers’s order and that it was an absolute long shot to be heard by SCOTUS. And there would be a lot of money spent just to do the appeal to the Fourth Circuit.

Yeah. Would you say a death row inmate dragged it out because they did 15 appeals over 10 years and got all the way to the supreme court? That's the system we set up.

And I think the Courts got it right. Looks like the judicial system worked. That's cause for celebration. But I would like to see this issue fixed so the next guy, Republican or Democrat, doesn't go through this again.

Yes, the death row inmate dragged it out in your example -- for good reason. I certainly wouldn't use the phrase "day" in court to describe his situation either.

I wouldn't celebrate the NC court of appeal and supreme court completely ignoring the equal protection clause for political reasons as getting it right. This litigation has been a huge black eye for the state -- all because Griffin was a sore loser and tried to steal an election with a bad faith, after-the-fact challenge to democratic voters.

Some of the courts didn’t get it right.

And are you really comparing someone raising colorable legal claims in an effort to avoid being put to death with a judge raising highly suspect claims in an attempt to change the rules after the fact and have votes thrown out? (Also you seem to be misinformed about how the appellate process works.)

The only thing that needs to be cleaned up are all of the POS desperate for power MAGA politicians and judges ruining NC and the US.

Okay. He got his days in court. I didn't know that's what you were worried about.

But just to let you know, day in court is a common expression. Even though most trials are not concluded in a single day, it's still common to say that a person got his day in court.

Bull. The death row inmates raise highly questionable legal claims all the time. It's the courts job to go through them. Just like it was the courts job to work on these claims.

Although you're very likely right that I'm misinformed on how the appellate process works.

It did not work. There's a lot more to a judicial system than getting to the right result.

It should be an utter embarrassment to the state that it took a federal court to order certification of victory. The federal court even signaled to the NC courts, "I'm going to let you do this because I trust you to do it right," and the NC state courts responded with "nah, not even going to try"

IIRC, the NC Supreme Court didn't even address the constitutional issues that ultimately prevailed in federal court. DIDN'T EVEN ADDRESS is a remarkably bad performance. If I'm wrong about the NC Sup Ct opinion, then I take those sentences back but obviously it did a terrible job with the constitutional issues because this wasn't even a close case.
